1. Acceptance of Terms
By accessing or using the WeatherView.io website and services ("Service"), operated by BlueGuard ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
WeatherView.io provides weather safety alert information and links to authoritative resources. Weather alerts are delivered to insurance policyholders on behalf of participating insurance carriers. The Service aggregates data from the National Weather Service (NWS), FEMA, the American Red Cross, and other public safety organizations.
3. No Guarantee of Accuracy
Weather data displayed on WeatherView.io is sourced from the National Weather Service and other third-party providers. While we strive to present accurate and timely information, we make no warranties or guarantees regarding the accuracy, completeness, or timeliness of any weather data. You should always refer to official NWS channels and local emergency management for life-safety decisions.
4. SMS and RCS Messaging
If you receive weather alert messages via SMS or RCS from your insurance carrier through our platform:
- Messages are sent on behalf of your insurance carrier, not by WeatherView directly.
- Message frequency varies based on weather activity in your area.
- Message and data rates may apply depending on your mobile carrier plan.
- To stop receiving SMS messages, reply STOP to any message you receive. You will receive a confirmation and no further messages will be sent.
- For help, reply HELP to any message, or contact your insurance carrier directly.
- Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major US carriers.
5. Use of the Service
You agree to use the Service only for lawful purposes. You may not:
- Attempt to disrupt, disable, or impair the Service or its underlying infrastructure.
- Scrape, data-mine, or systematically download content from the Service for commercial purposes without prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
6. Intellectual Property
The WeatherView and StormGuard names, logos, and design elements are trademarks of BlueGuard. Weather data sourced from the NWS is in the public domain. All other content, code, and design on this site is the property of BlueGuard and is protected by applicable intellectual property laws.
7. Third-Party Links
The Service contains links to third-party websites including the National Weather Service, Red Cross, FEMA (ready.gov), the Insurance Institute for Business & Home Safety (DisasterSafety.org), and the Insurance Information Institute (iii.org). We are not responsible for the content or privacy practices of these external sites.
8. Limitation of Liability
To the maximum extent permitted by law, BlueGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of property, personal injury, or loss of data, arising from your use of or inability to use the Service. The Service is provided for informational purposes and does not replace official emergency alerts, warnings, or instructions from local authorities.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold harmless BlueGuard, its officers, directors, employees, and agents from any claims, losses, or damages arising out of your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
